The condo board at The Bennett in upper Manhattan is being sued for illegally blocking the sale of two condominiums on the property. The board claims that the intended use of the units, i.e. a nonprofit organization allowing clients with mental disabilities to live there, violates condo bylaws.
It's time that condo boards learn that they can't just make any rule they damn well feel like. Bylaws can't directly violate local, state, and federal laws, such as a little thing called the Americans with Disabilities Act. And, living in a condo myself, I personally feel that laws need to be enacted to further limit what kinds of rules condo and homeowners' associations can make and enforce, and to require that they demonstrate good, legitimate reason for those rules. Rules that are made for no reason other than it was someone's personal preference at the time simply don't fly with me, and they haven't since I was about twelve years old.
